SCHOOL YEARS, INC.
1. Agreement and Services
These Terms and Conditions ("Terms") govern access to and use of the School Years mobile application, website, software, and related offerings (collectively, "Services") operated by School Years, Inc. ("School Years," "we," "us"). By activating an account or using the Services, you agree to these Terms, subject to applicable law and any required parent or guardian authorization. If you do not agree, do not use the Services. Our Privacy Policy describes our handling of personal information.
2. Accounts, Eligibility, and Parent Mode
Schools and/or authorized photography partners may supply information used to establish student profiles before registration. Students or their authorized parents/guardians activate access by verifying student information, including Student ID and date of birth. Users must provide accurate information, safeguard account access, and promptly notify us of suspected unauthorized use. Do not claim another person's account.
Parent Mode permits a parent/guardian to access their child's account subject to the features and restrictions we make available. Parent Mode does not permit interaction with other student accounts. Access by children, parental authorization, and school permissions remain subject to applicable law and School Years' procedures.
3. Access, School Communities, and Alumni
Features and visibility vary by school, account type, and purchases. The news feed is available without charge; access to student profiles and school content may require purchase. Student profile access is restricted to the applicable school community; alumni profiles are accessible to eligible alumni under our access rules. Users must not circumvent access controls or disclose other users' nonpublic information.
Upon graduation, an eligible student profile may transition to an Alumni Profile, with continued access to available features and the ability to add college, field of study, contact information, and social links. School Years does not guarantee that any feature, content, account, or purchase will remain available indefinitely.
4. Purchases and Digital Content
The Services may offer paid access to a digital school content book and optional student tribute pages. Prices and purchase terms are presented before purchase. Purchases made through Apple in-app purchase are processed by Apple and subject to applicable Apple payment, billing, and refund procedures, together with nonwaivable consumer rights. Unless expressly stated at purchase, payment grants access to designated digital content while it remains available through the Services; it does not transfer ownership of content or guarantee perpetual hosting or access.
5. User Content and Permissions
Users may submit permitted material, including tribute-page photos and videos, profile details, senior quotes, and limited profile writings ("User Content"). You retain whatever ownership rights you have in User Content. You grant School Years a nonexclusive, worldwide, royalty-free license, for as long as reasonably necessary to provide the Services and comply with applicable obligations, to host, store, reproduce, adapt for technical display, display, and distribute User Content within the Services in accordance with account settings and permissions.
You represent that you have the rights and permissions necessary to submit User Content and that it does not violate others' intellectual property, privacy, or publicity rights. School Years may review, restrict, or remove content that violates these Terms or applicable law. School- and photographer-supplied material is used subject to applicable permissions and agreements; nothing here transfers third-party ownership to School Years.
6. Acceptable Use
You may not impersonate others, harass or bully users, post unlawful or infringing content, attempt unauthorized access, scrape or harvest student information, bypass paywalls or school access restrictions, reverse engineer the Services except where prohibited by law, introduce malware, disrupt operations, or use the Services for unlawful purposes. School Years may remove content or restrict access for suspected violations, subject to applicable law and agreements.
7. Child Safety and Protection
At School Years, we maintain a zero-tolerance policy against Child Sexual Abuse and Exploitation (CSAE) and Child Sexual Abuse Material (CSAM). We prohibit creating, uploading, publishing, distributing, or facilitating content involving child sexual abuse or exploitation through the Services.
To report content, users, or activity that may violate these standards, or to raise a child-safety concern, contact our designated safety contact at support@school-years.com. We may remove prohibited content, restrict or terminate accounts, and report suspected violations to appropriate authorities as required by applicable law.
8. School Years Intellectual Property
The Services, including School Years' software, code, interface, design, trademarks, branding, compilations, and proprietary technology, are owned by School Years or its licensors and protected by applicable law. We grant a limited, personal, revocable, nonexclusive, nontransferable right to use the Services in accordance with these Terms. No other rights are granted. User, school, and photography content may be owned by others.
9. Availability, School Relationships, and Termination
School Years may update, suspend, modify, or discontinue features or the Services, subject to applicable law and contractual obligations. A school's discontinuation of participation does not automatically terminate existing profiles; however, School Years may remove information or content where required by law, an applicable agreement, a valid rights-holder request, or an authorized school request. Users may request account deletion through the app. If School Years ceases operations, access to accounts and purchased digital content may end.
10. Third-Party Services and Links
We may use service providers for hosting, storage, payment processing, and related operations. Third-party links or services may have their own terms. Our Privacy Policy explains relevant information practices. Nothing in these Terms authorizes disclosure of student information beyond what law and applicable agreements permit.
11. Disclaimers and Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, EXCEPT WHERE SUCH WARRANTIES CANNOT BE DISCLAIMED. SCHOOL YEARS DOES NOT WARRANT UNINTERRUPTED ACCESS, ERROR-FREE OPERATION, OR PERMANENT AVAILABILITY OF CONTENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCHOOL YEARS AND ITS OFFICERS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OR LOST PROFITS, DATA, OR GOODWILL ARISING FROM THE SERVICES. NOTHING HERE EXCLUDES LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED.
12. Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless School Years and its officers, directors, employees, and agents from third-party claims arising from your unlawful use of the Services, your User Content, or your material breach of these Terms, except to the extent caused by School Years' own wrongful conduct.
13. Disputes and Governing Law
Florida law governs these Terms except where preempted or where mandatory consumer protections apply. Disputes will be resolved through binding individual arbitration under the Federal Arbitration Act, administered by the American Arbitration Association under applicable consumer rules, unless applicable law requires otherwise.
14. Changes; General
We may revise these Terms. We will provide notice of material changes as required by law, and the updated effective date will be displayed. Continued use after an effective change may constitute acceptance where lawful. If a provision is unenforceable, the remainder stays effective. These Terms and any applicable purchase terms comprise the agreement regarding the Services, subject to school agreements and nonwaivable rights.
